Partner & Family Visas

Subclass 820/801Partner visas: are applied for at the same time, and are a permanent visa pathway for a de facto or spouse partner of an Australian citizen, permanent resident, or eligible New Zealand citizen. This is a two-step process. The 820 visa (temporary) is granted first and leads to the permanent 801 visa. These visas must be applied for in Australia.

Subclass 309/100 Partner visas: are also a pathway to permanent residency for a de facto or spouse partner of an Australian citizen, permanent resident, or eligible New Zealand citizen, but the applicant must be outside of Australia at the time of application. The subclass 100 visa is permanent and is usually granted to the holder of a 309 visa.

Subclass 300 Prospective Marriage visa: for applicants who want to come to Australia to marry their prospective spouse. Applicants must be outside Australia. Once granted the holder can travel to and stay in Australia for 9 to 15 months, and if they wish to stay in Australia should apply for subclass 820/801 Partner visas.
